XENIA TOWNSHIP GUIDELINES FOR SIGN PLACEMENT

Ohio law states that signs, regardless of their purpose, cannot be placed in road rights-of-way or attached to signs and posts. 

 

The road right-of-way can vary from 30 feet to 120 feet wide depending on the road.  A good general rule of thumb is signs should be placed behind the telephone poles, in farm fields, or behind the sidewalks.  This means that no signs should be positioned in the area between the curb and the sidewalk on roads with curbs or in front of telephone poles. 

 

Signs can be placed on private property only with the consent of the property owner and in compliance with right of way ordinance.

  

If signs are placed incorrectly, we will remove the signs and you will be able to retrieve your signs from 125 Fairground Rd. Xenia, Ohio.  They will be placed inside a crate located outside the security fence.



Zoning Permit Questions

Why is a Zoning Permit required?

Xenia Township adopted a zoning resolution that regulates the development and use of land within the Township. These regulations protect the health, safety and general welfare of residents and property owners by creation of zones to prevent incompatible uses in close proximity to each other. The regulations also maintain the character of established neighborhoods and prevent inappropriate activities, such as automotive repairs in residential areas.

Permitted and conditional uses are designated for each zone. Permitted uses are controlled by specific regulation, such as setback lines, square footage, etc. An example of a permitted use is a single family residence. Conditional uses are approved by the Board of Zoning Appeals, which sets conditions particular to the requested use.

The Xenia Township Zoning Inspector issues zoning permits for buildings and structures that conform to regulations set forth in the Zoning Resolution. The zoning permit is the property owner's documentation that construction has been reviewed, inspected and approved by the Zoning Inspector. A building permit is also required from Greene County Building Regulations before construction begins. A zoning permit is required to obtain a building permit.

When is a Zoning Permit required?

A zoning permit is required for all types of construction:

  1. Residential - new dwellings, garages, sheds, fences, pools, patio and porch covers and enclosures, decks, additions, alterations, exterior structural repairs
  2. All commercial construction
  3. Signs and tents
  4. Driveways (approved by road Superintendent)

 

What Do I Need To Get A Zoning Permit?

  1. Zoning permit application and fee.
  2. Site plan (drawing of property indicating location and measure of distances from structures to property lines and other structures).
  3. Construction drawings.
  4. For new residence--Board of Health septic approval, if applicable.
  5. Submit all information to Xenia Township Zoning Inspector for review and approval.

517  PERMITTED SIGNS (basic, electric, billboard)

  1. The regulations herein set forth shall apply and govern in all districts. No sign shall be erected or maintained unless it is in compliance with the regulations for the district in which it is located. No sign shall be erected or continued in operation in any manner constituting a nuisance because of glare, focus, animation or flashing.
  2. All signs hereafter erected, constructed or modified shall be exempt from yard and setback requirements of the districts in which they are located. All signs are prohibited in the right-of-way.
  3. Where permitted, all illuminated or electronic signs shall be designed, constructed, and operated so as to prevent glare upon the street or adjacent property. Both strobe and full motion video effects are prohibited. Such illuminated or electronic messages shall be turned off no later than 11:00 P.M. when such sign is within two hundred (200) feet of an R-1, RM, R-MH, or E District.
  4. No sign shall be erected, relocated, or maintained so as to delay free ingress to or egress from any door, window or fire escape.
  5. No sign shall be erected at the intersection of any street or driveway in such a manner as to obstruct free and clear vision of roadway traffic.
  6. No sign shall be erected at any location where, by reason of the position, shape or color, it may interfere with, obstruct the view of, or be confused with any Uniform Traffic Control Devices; or which makes use of the words “STOP”, “LOOK”, “DANGER”, or any other words, phrases, symbol or character in such manner as to interfere with, mislead or confuse the public.
  7. It shall be unlawful for any person to display upon any sign or other advertising structure any obscene, indecent or immoral matter, including any message or image that identifies sexual activities or anatomical areas in a sexual manner.
  8. Maximum height above grade at the top of the sign shall not exceed forty (40) feet.
  9. No sign shall be placed nearer than ten (10) feet to an adjacent residential district lot line. Where an illuminated sign face exceeds fifty (50) square feet in area it shall not be placed nearer than fifty (50) feet to an adjacent residential lot line.
